1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website and staffing services of J&D House Cleaning LLC ("J&D", "we", "us", or "our"). By using our services, providing your phone number, or consenting to receive communications from us, you agree to be bound by these Terms. If you do not agree, do not use our services or provide your contact information.

2. Description of Services

J&D provides temporary labor staffing for restoration, demolition, industrial cleaning, and related projects. We connect workers with contractors, restoration firms, and industrial operators on a temporary, project, or per-assignment basis. We act as the employer of assigned temporary workers unless otherwise stated in a separate written agreement. The specific terms, duration, and conditions of any assignment are set out in the job offer or assignment details we send you.

3. WhatsApp Communications Consent

By providing your phone number to J&D and confirming your consent, you agree to receive recurring automated and manual communications from us through WhatsApp, the messaging service operated by Meta Platforms, Inc. ("WhatsApp", "Meta"). J&D uses the WhatsApp Business platform to send these messages, which may also include phone calls and emails. These communications may include:

• Job Offers & Work Assignments: WhatsApp notifications about available shifts, project placements, job site details, and start instructions.
• Transactional Messages: Payroll updates, scheduling confirmations, shift changes, check-in reminders, and other WhatsApp messages necessary to manage your assignments.
• Operational & Safety Alerts: Time-sensitive notices such as cancellations, location changes, or safety information relevant to your assignment.
• Account & Service Messages: Updates related to your worker profile, documents, and account status.

You understand that message and data rates may apply, and that Meta processes WhatsApp messages in accordance with its own Terms of Service and Privacy Policy. Your use of WhatsApp is also subject to Meta's terms. Consent to receive messages is not a condition of any purchase. You may opt out at any time by replying "STOP" to a WhatsApp message, by email at info@jdstaffing.com, or by calling (214) 999-9999. Opting out of transactional messages that are necessary to fulfill a current assignment may affect our ability to place you on future jobs.

4. Worker Responsibilities

If you are placed on an assignment through J&D, you agree to:

• Arrive on time and prepared for each assigned shift.
• Perform your duties safely, lawfully, and in accordance with the client's site rules and all applicable regulations.
• Comply with safety protocols, including the proper use of personal protective equipment.
• Provide accurate information regarding your identity, work authorization, skills, and availability.
• Notify J&D promptly of any change in availability, contact information, or ability to complete an assignment.
• Keep confidential any proprietary or sensitive information you learn at a job site.

J&D may terminate or decline to renew any assignment if a worker fails to meet these responsibilities, violates site rules, or otherwise acts in a manner inconsistent with the safe and professional delivery of services.

5. Client Responsibilities

If you engage J&D to provide temporary workers, you agree to:

• Provide a safe job site and adequate supervision for assigned workers.
• Communicate project requirements, schedules, and any hazardous conditions in advance.
• Pay all invoices issued by J&D in accordance with the agreed payment terms.
• Not directly hire or solicit J&D workers for a period specified in your service agreement without our prior written consent.

6. Payment & Invoicing

J&D issues invoices weekly upon completion of each work week. Clients are responsible for paying invoices in accordance with the terms set out in their service agreement. Workers are compensated by J&D according to the terms communicated for each assignment. Any disputes regarding invoices or compensation must be reported to J&D within thirty (30) days of the invoice or payment date.

7. No Guarantee of Assignment

Providing your contact information and consenting to receive communications does not guarantee that you will be offered work. Job offers depend on project availability, your qualifications, and the needs of our clients. Likewise, J&D does not guarantee any specific volume or duration of work to clients.

8. Limitation of Liability

To the maximum extent permitted by law, J&D shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to these Terms or the use of our services. Our total liability for any claim arising out of these Terms or any assignment is limited to the amount you paid us, or we paid you, in the thirty (30) days preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless J&D, its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misconduct on a job site, or your violation of applicable laws.

10. Privacy

Our collection, use, and sharing of your personal information — including the phone number you provide and your consent to receive text messages and calls — is described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Changes to These Terms

We may revise these Terms at any time. The most current version will always be posted on this page with a revised "Last updated" date. Your continued use of our services or continued consent to receive communications after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Dallas County, Texas.
